Kindo Terms & Conditions

1) Who we are

These Terms & Conditions (“Terms”) govern your use of Kindo and our website Kindoapp.com (the “Website”) and related services (the “Service”). “Kindo”, “we”, “us”, and “our” refer to the operator of Kindoapp.com. “You” means the person or entity using the Service.

By accessing the Website or using the Service, you agree to these Terms and to our Privacy Policy and Cookie Policy.

2) Eligibility & accounts

  • You must be at least 18 and able to form a contract to use Kindo.

  • You’re responsible for keeping your account details (including login credentials) secure and for all activity under your account.

  • If you connect via your employer or nursery, you confirm you have the authority to do so.

3) The Service (what we provide)

Kindo is a UK nursery fintech platform that helps parents unlock value from nursery fees via employer- and partner-backed rewards, cashback and related features. We may add, change, or remove features from time to time.

4) Licences & acceptable use

  • We grant you a revocable, non-exclusive, non-transferable, limited licence to access and use the Website and Service in accordance with these Terms.

  • You agree not to:

    • copy, modify, reverse engineer or create derivative works of the Service;

    • rent, lease, sell, sublicense, or otherwise commercialise access;

    • remove or alter ownership or attribution notices;

    • use the Service unlawfully or in a way that harms Kindo, users, nurseries, or employers (e.g., fraud, misuse of offers, scraping, interference, or introducing malware).

5) Fees, payments & rewards

  • Some features may require subscription fees or employer/nursery participation. We’ll show prices before you commit.

  • Rewards/cashback amounts, eligibility, timing, and methods of payment can vary by employer plan, nursery participation, and offer terms.

  • We may correct errors (including pricing or display errors) and adjust or withdraw offers where necessary.

  • Where applicable, you’re responsible for any taxes arising from rewards or benefits.

6) Employer & nursery participation

  • Employer- or nursery-funded rewards require your employer/nursery to be enrolled and in good standing with Kindo.

  • If your employer/nursery participation ends (e.g., contract expiry, non-payment, or plan change), related benefits may stop or change.

  • Kindo is not a party to your employment or nursery contract and isn’t responsible for employer/nursery decisions.

7) Third-party services & links

The Service may link to or rely on third-party sites, services, processors, analytics, or content. We don’t control or endorse third parties and aren’t responsible for their content, policies, or actions. Your use of third-party services may be governed by their terms.

8) Privacy & cookies

Your personal data is handled as described in our Privacy Policy. We use cookies and similar tech as described in our Cookie Policy. You can manage cookie preferences via your browser or our cookie settings (functionality may be affected).

9) Intellectual property

The Website, Service, and all related content, features, and functionality (including text, graphics, logos, software and designs) are owned by Kindo or our licensors and are protected by UK and international laws. No rights are granted except as expressly set out in these Terms.

10) Feedback

If you provide ideas, suggestions, or feedback (“Feedback”), you grant Kindo a perpetual, worldwide, irrevocable, royalty-free licence to use it without obligation to you.

11) Returns, cancellations & changes

  • Because Kindo provides digital/benefits services, statutory cooling-off or refund rights may be limited once benefits are activated or consumed. We’ll be transparent at point of purchase/upgrade.

  • We may update prices, plans, and features. If we make material changes to paid plans, we’ll notify you in advance where required by law.

12) Disclaimers

The Website and Service are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties (express, implied or statutory), including merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability. We do not guarantee uninterrupted or error-free operation or that defects will be corrected.

Any information on the Website is for general information only and not professional advice (including financial, legal, tax or health advice). You should obtain professional advice where appropriate.

13) Limitation of liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so (including liability for death or personal injury caused by negligence or for fraud).

Subject to the above, Kindo will not be liable for:

  • loss of profits, revenue, data, business, goodwill, or anticipated savings;

  • indirect, consequential, special, or punitive damages;

  • losses arising from third-party sites or services, or from employer/nursery decisions;

  • any amount greater than the total fees you paid to Kindo in the 12 months before the event giving rise to liability (if any).

14) Suspension & termination

We may suspend or terminate your access (with or without notice) if you breach these Terms, misuse the Service, or where we reasonably need to protect users, partners, or Kindo. You may stop using the Service at any time. Sections that by nature should survive termination will survive (e.g., IP, liability limits).

15) Changes to these Terms

We may update these Terms to reflect changes to the Service, legal or regulatory requirements. If changes are material, we’ll provide notice where required (e.g., on-site notice or email). Continued use after updates means you accept the new Terms.

16) Governing law & venue

These Terms and any non-contractual obligations arising out of them are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction, except that consumers resident elsewhere in the UK or EU may also bring claims in their local courts under mandatory local law.

17) Miscellaneous

  • Severability: If a provision is unenforceable, the rest remain in effect.

  • No waiver: Failure to enforce a provision is not a waiver.

  • Assignment: You may not assign these Terms without our consent. We may assign them in connection with a merger, sale, or reorganisation.

  • Entire agreement: These Terms, plus our Privacy Policy and Cookie Policy, are the entire agreement between you and Kindo regarding the Service.

  • Headings: For convenience only.
